Short Title: Manufactured Home Document
Recording

Requires certain documents related to an application for a
certificate of title for a manufactured home to be filed and
recorded by a county clerk and recorder. Creates the following new
certificates (certificates) related to a manufactured home that are
also required to be filed and recorded by a county clerk and
recorder:
* A certificate of permanent location, which is used when the
manufactured home is permanently affixed to the ground;
* A certificate of removal, which is used when the manufactured home
is removed from its permanent location; and
* A certificate of destruction, which is used when a manufactured
home is destroyed, dismantled, or sold or otherwise disposed of as
salvage. Requires the property tax administrator to establish the
form of the certificates, which must include specified information
for each certificate. Wherever possible, requires a certificate to
be filed with an authorized agent of the department of revenue in
conjunction with a current process related to a certificate of
title. In all other cases, requires a certificate to be filed
directly with a county clerk and recorder. Requires an authorized
agent who is not a clerk and recorder who receives a document for
filing and recording to forward the document to the clerk and
recorder for filing and recording in his or her office. Requires
documents to be indexed. Requires a clerk and recorder to forward a
copy of the certificates to the assessor for the county or city and
county. Establishes fees for the filing and recording of the
documents. Creates an affidavit of real property, which can be used
to prove that a manufactured home and the land upon which it has
been permanently affixed are real property. Requires any
manufactured home title application that is submitted to an
authorized agent to be accompanied by a declaration, completed and
signed by the purchaser or transferee, that contains information to
assist the assessor in determining the value of real property.
Requires the authorized agent to forward the declaration to the
assessor. Makes conforming amendments.
