After consideration on the merits, the Committee recommends that HB08-1349 be
amended as follows, and as so amended, be referred to the Committee of the Whole with
favorable recommendation.

Amend reengrossed bill, page 3, line 19, after "OVERPAYMENTS.", add
"THE PROVISIONS OF THIS SUBPARAGRAPH (III) SHALL NOT APPLY TO A
CITY AND COUNTY.".

Page 4, strike lines 1 through 3 and substitute the following:

"TAXES THAT ARE PLACED IN A RESERVE FUND TO BE RETURNED TO THE
COUNTY FOR REFUNDS OF OVERPAYMENTS BY TAXPAYERS; EXCEPT THAT
THIS LIMITATION ON THE EXTENSION OF THE IRREVOCABLE PLEDGE SHALL
NOT APPLY TO A CITY AND COUNTY.";

line 21, after "OVERPAYMENTS.", add "THE PROVISIONS OF THIS
SUBPARAGRAPH (III) SHALL NOT APPLY TO A CITY AND COUNTY.".
